We, at Amy’s Kitchen, Inc. (hereinafter “Amy’s Kitchen”), value and are committed to protecting your privacy. With a view to transparency, this Policy describes the type of information we obtain about you when you visit our website at www.amys.in or any of its technical modifications, including as mobile website, application, etc. (hereinafter collectively referred to as our “Website”), and how we may collect, use, protect and share that information. Every user who accesses or uses the Website agrees to be bound by the terms of this Policy and terms of use for access or usage of Website (“Terms of Use”).

1. Scope of this Policy

This Policy is intended for users in India and is governed by the Information Technology Act, 2000 (“IT Act”) read with Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 as amended from time to time (hereinafter the “IT Rules”). By providing us with information identified in this Policy, you acknowledge and explicitly consent to (1) the transfer of information to servers which may be located outside India, and (2) our use and disclosure by us or our affiliated companies of your information consistent with this Policy.

Our Website is not intended for use by children under the age of 18 years. We do not knowingly solicit or collect personal information from children under 18 years. In the event we learn that we have collected personal information from a child under the age of 18 years old without verification of parental consent, we will delete that information as quickly as possible and, if possible, discontinue access to our Website. If you believe we might have information from or about a minor under 18 years, please contact the Grievance Officer as identified below in this Policy.

2. Personal and Non-Personal Information

Personal information that Amy’s Kitchen may collect is information that relates to a natural person that either directly or indirectly, in combination with other information available or likely to be available to us, is capable of identifying such person, such as your name, address, phone number, email address and billing information.

Sensitive personal data or information means personal information which is sensitive in nature and has higher standards of security. Such information is defined under the IT Rules to mean information relating to your password, financial information (including, for example, bank account, credit or debit card, or other payment instrument details), physical, physiological and mental health condition, sexual orientation, medical records and history, biometric information, etc. Please note that Amy’s Kitchen does not collect any such sensitive personal data or information. You are required to be cautious in ensuring that you do not submit or provide any such information to us through our Website.

Non-personal information that Amy’s Kitchen may collect is information that does not identify you, but can include information about your internet connection, the computer you use to access our Website and other usage details.

3. Information That You Provide Us Directly

The information we collect from you on our Website may include:

a. information that you provide while registering with us on our Website;

b. copies of your correspondence (including email addresses), if you communicate with us electronically;

b. Web beacons/clear gifs, which are small electronic files that allow us to anonymously track the online usage patterns of our users and to track when and which emails we send you are opened by you.

d. Location and device specifications, which include information regarding your location and the specifications of the device that you are using to access our Website. This data is used for our analytical purposes and is not attributable to individuals and shall be collected and used as per terms hereof.

Due to the communications standards on the internet, when a user visits the Website, we automatically receive the uniform resource locator (“URL”) of the site accessed by the user before accessing the Website and the site accessed by the user after accessing the Website. We also receive the internet protocol (“IP”) address of each user’s computer (or the proxy server via which a user accesses the internet), the user’s computer operating system and the type of web browser the user is using, as well as the name of user’s internet service provider (“ISP”). This information is used by us to analyze the overall trend of usage and to also improve our services.

We do not link non-personal information with personal information. We use this non-personal information in an aggregate way to monitor usage and improve our Website. These tools do not contain any personally identifiable information such as your name or email address.

5. How We Use Your Information

When you give or make available information to us, we use it in the ways for which you have given us permission, such as to subscribe to our newsletter or to purchase our products. We use the statistical data we collect to customize content for you, to improve our Website and to enhance the products and services we may provide through the information available on our Website.

We do not sell or share your personal information to third parties except to help us provide the information that you have requested. Other than as set out in this Policy, we shall NOT sell or disclose your personal data or information to third parties without obtaining your prior consent

6. How We Protect Your Information

We take precautions to protect your personal information once we receive it. We have measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All personal information you provide us is stored on secure servers behind firewalls. Further, once your information is in our possession, we adhere to strict security guidelines in compliance with the IT Act and the IT Rules promulgated thereunder to protect your information against unauthorized access.

7. Choice/Opt-Out

Amy’s Kitchen does not currently collect information for the purposes of subscribing to newsletters, or to enter into a contest or promotion. However, if Amy’s Kitchen ever collects information for these purposes, users have a qualified right to access, rectify, delete, or object (to the processing of) personal information stored by us. Please note that Amy’s Kitchen shall not be responsible for the authenticity or accuracy of any such information provided by you through our Website. You are responsible for informing us about changes to your personal information and for ensuring that such information is accurate and current.

Our Website may contain links to other websites that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices or policies of these unaffiliated websites. There may be a number of services offered by external service providers that help you use our Website.
